Executors of deceased estates can now make lump sum payments to the surviving spouse of a deceased entitled to maintenance in terms of the Maintenance of Surviving Spouses Act, but death benefits bequeathed to beneficiaries will not form part of the deceased estate and should be excluded when the value of the deceased estate is determined for the purposes of establishing whether the estate has the ability to maintain the surviving spouse.
